Vienna, October 24th, 2017. The Austrian Federal Competition Authority (in German: Bundeswettbewerbsbehörde – BWB) presented today at the 33rd Competition Talk, its new "Guidance on dawn raids".
The Guidance describes the start, expiry and end of a dawn raid, the rights and obligations of BWB employees as well as the rights and obligations of the company and its employees. The aim is to improve legal certainty and transparency for affected companies and their employees.
The guidance includes the current legal situation, the current jurisprudence of the cartel court and the supreme cartel court, as well as national and European best practices.
Further on it provides a detailed overview of the procedure for dawn raids of the BWB. "The intention is to serve a guide to companies and their employees. Transparency, comprehensibility and clarity of administrative actions are essential contributions to public trust" said Director General Dr. Thanner.
