The Competition Act 2005 provides a Leniency Program in Austria.
According to § 11 para 3 WettbG the Federal Competition Authority may refrain from seeking the imposition of a fine for undertakings that discover a cartel or, if the Federal Competition Authority already knows the facts, it may seek a reduced fine. The Federal Competition Authority informs the Federal Cartel Prosecutor about the granting of leniency. In this case, the Federal Cartel Prosecuter loses his right to impose a fine against the undertaking (§ 29 para 3 KartG).
